Hedlund v. Educational Res. Inst. Inc.

District court erred in reinstating student loan debt after de novo, rather than clear error, review of finding of good faith.
Procedural posture

Debtor, a law school graduate, sought a discharge of his student loans under 11 U.S.C.S. § 523(a)(8). The bankruptcy court granted a partial discharge, but, on appeal, the U.S. District Court for the District of Oregon reinstated the student loan debt in full as non-dischargeable, finding that debtor had not acted in good faith, which was one of three prerequisites for relief under 11 U.S.C.S. § 523(a)(8). Debtor appealed.
