Lowe v. Palmetco Inc. (In re NA Flash Found. Inc.)

District court properly upheld bankruptcy court finding that transfers from debtor contractor to supplier were not preferential due to operation of state law.
Procedural posture

Plaintiff trustee sued to recover payments a debtor contractor made to defendant supplier as preferential transfers under 11 U.S.C.S. § 547(b). Essentially affirming the bankruptcy court in part, the United States District Court for the Western District of Texas held the supplier would have received the same amount under a construction trust fund theory, but not under materialman's lien theory. The trustee appealed.
