Mitchell v. Bigelow (In re Mitchell)

Bankruptcy court erred in disallowing willful and malicious injury claims of debtor's stepson.
Procedural posture

Appellant creditor, a stepson of the appellee debtor, sought review of an order of the United States Bankruptcy Court for the Northern District of Iowa, that determined that the debtor's obligation to him was not excepted from her discharge. The appeal turned on the proper legal interpretation of 11 U.S.C.S. § 523(a)(3), therefore was subject to de novo review.
