Blocker v. Patch (In re Patch)

Ruling that debt resulting from murder of debtor's son by debtor's live-in boyfriend was nondischargeable reversed due to failure to establish that death was a willful act of the debtor.
Procedural posture

Debtor appealed the judgment of the Bankruptcy Appellate Panel of the Eighth Circuit (BAP), which affirmed a bankruptcy court's sua sponte entry of summary judgment in favor of the trustee for the heirs and next of kin of debtor's decedent son concluding that debtor's unliquidated debt, owed to the trustee, was nondischargeable under 11 U.S.C.S. § 523(a)(6).
