Lento v. Marshall (In re Marshall)
Plaintiff creditor, a stone material supplier to the construction industry, sued for a determination that a debt owed by defendant debtor, who sold and installed stone products, was excepted from discharge under 11 U.S.C.S. § 523(a)(4) as having been obtained by embezzlement. Specifically, the creditor contended that the debtor wrongfully appropriated the proceeds of consigned goods; the debtor maintained that the parties had an open account.
Ruling:
Debtor's use of sale proceeds owed to creditor under consignment agreement was nondischargeable on grounds of embezzlement.
