Procedural posture

Debtor petitioned the bankruptcy court for chapter 7 relief approximately 73% of the way through the 2007 tax year. The trustee moved for turnover of the estate's share of debtor's 2007 federal and state tax refunds under 11 U.S.C.S. § 542. Debtor objected to the motion. The bankruptcy court and the District Court for the Southern District of Illinois ordered debtor to turn over the amount requested by the trustee. Debtor appealed.
