Procedural posture
Cross motions for summary judgment were filed as to claims by plaintiff, who had recovered a state court judgment against debtor, that such obligation was nondischargeable per 11 U.S.C.S. § 523, by debtor. Issues included whether debtor was collaterally estopped by the state court judgment, which he did not appeal, from litigating dischargeability of the award, which included compensatory and punitive damages and attorney's fees and costs.
