Appellant, the Massachusetts Department of Unemployment Assistance (DUA), challenged a decision of the United States Bankruptcy Court for the District of Massachusetts, which enforced pursuant to 11 U.S.C.S. § 363(f) the sale of the debtor's assets free and clear of any interest in the assets, including the DUA's right to tax the purchaser at the debtor's unemployment contribution rate.
