Wachovia Bank v. Levin

Appellants appealed from an order of the Bankruptcy Court for the Eastern District of North Carolina which granted summary judgment in favor of appellee chapter 7 trustee as to the debtor's future remainder interests in the 1976 Trust and Will Trust created by the debtor's grandmother, holding that the debtor's future interests in the principal of the 1976 Trust and the Will Trust were property of the bankruptcy estate.
Ruling: 
Bankruptcy court erred in finding that debtor's future interests in spendthrift trusts were property of the estate.
