Procedural posture: 
In an action by plaintiff, the Secretary of Labor for the U.S. Department of Labor (Secretary), alleging that defendants, including an involuntary debtor, violated the Employee Retirement Income Security Act of 1974, 29 U.S.C.S. § 1001 et seq., the Secretary filed a motion pursuant to Fed. R. Civ. P. 59(e) to reconsider the court's sua sponte dismissal of one of the defendants. Two of the defendants filed a pro se motion to dismiss the Secretary's action.
