In re Porayko

Ruling:
Relief from stay granted to allow creditor to pursue state law rights in funds in debtor's account.
Procedural posture:
A judgment creditor moved for relief from the automatic stay. The creditor sought relief from the stay under 11 U.S.C.S. § 362(d) in order to pursue his rights under state law to seek turnover of funds from the debtor's checking account. The chapter 7 trustee objected on the grounds that any lien the creditor might have on those funds was avoidable, and thus the estate's claim to the funds was superior to the creditor's.
